Agreement

These Terms of Service ("Terms") govern your access to and use of Cherry Moments at cherrymoments.com ("the Service"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

The Service

Cherry Moments lets you create personal event websites — for example, for weddings, birthdays, and baby showers — and optionally publish them for guests to view. Features may change over time as we improve the product.

Your account

You sign in using Google. You are responsible for activity that occurs under your account and for keeping your Google account secure. Notify us promptly if you suspect unauthorized access.

Your content

You retain ownership of the text, photos, and other materials you upload ("Your Content"). By using the Service, you grant us a non-exclusive, worldwide license to host, store, reproduce, and display Your Content solely to operate the Service — including showing published event pages to visitors you share them with.

You represent that:

• You have the rights needed to upload and share Your Content.
• Your Content does not violate any law or infringe anyone's intellectual property, privacy, or other rights.
• You have permission from anyone identifiable in photos or personal details you publish.

Published events

Publishing an event makes the content you include publicly available at your event's URL. You control whether and when to publish. We are not responsible for how visitors use information you choose to make public.

Acceptable use

You agree not to:

• Use the Service for unlawful, harmful, or fraudulent purposes.
• Upload malware or attempt to disrupt or gain unauthorized access to the Service.
• Harass, impersonate, or violate the rights of others.
• Use the Service to send spam or unsolicited commercial messages.
• Scrape or overload our systems without permission.

We may suspend or terminate access if we reasonably believe you have violated these Terms.

Third-party services

Sign-in is provided by Google and subject to Google's terms and policies. The Service may link to third-party sites; we are not responsible for their content or practices.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHERRY MOMENTS AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) USD $100.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms or if we discontinue the Service. Upon termination, your right to use the Service ends, but sections that by their nature should survive (such as disclaimers and limitations of liability) will remain in effect.

Changes

We may update these Terms from time to time. If changes are material, we will post the updated Terms on this page with a new effective date. Continued use after changes take effect constitutes acceptance of the revised Terms.
